24racks cloud Terms of Service

1. Acceptance and Definitions

1.1 By accessing the hosting services offered by 24racks cloud, the user agrees to comply with all terms and conditions established in these Terms of Service. The user acknowledges having fully read and understood these terms and agrees to be bound by them.

1.2 Definitions:

  • Customer Area: The portal where customers can manage all services, accessible with their credentials at https://24racks.com.
  • Credentials: The email and password used during registration to access the Customer Area.

2. Terms of Use

2.1 Delivery

Our services have a maximum delivery time of 7 days. In the case of dedicated servers, this period may be extended up to 4 weeks due to additional configuration and installation requirements.

2.2 Machine Storage Content

24racks cloud respects the privacy of its users and does not access the content of disks without prior authorization. However, for game servers and VPS, if the client expressly authorizes it, 24racks cloud can access the content to provide technical support or perform maintenance. We are not responsible for any data loss caused by user actions or negligence. Users are strongly encouraged to maintain their own backups.

2.3 IP Connectivity

Each VPS, VDS, and dedicated server is assigned a unique IPv4 address. This address should not be used to perform DDoS attacks, BotNet operations, or any other illegal activity. Any illegal action detected by the 24racks cloud team will be processed in accordance with applicable laws.

3. User Obligations

3.1 Information

Users must provide accurate and truthful information during account setup at billing.24rackscloud.com. Accounts found with false information will be terminated immediately without refund.

3.2 Credential Security

Users are responsible for safeguarding their account credentials. 24racks cloud provides features such as password reset to help maintain security.

3.3 Harmful Activities

Users must not use their accounts for fraudulent or illegal activities. Any violation will result in immediate suspension or termination of the account.

4. Conditions of Use and Prohibited Actions

4.1 Resources

The machine resources provided may be used for any legal purpose, except for the following prohibited activities:

  • Cryptocurrency mining
  • Participation in illegal activities
  • Actions aimed at damaging or interfering with 24racks cloud hardware or network
  • Remote DDoS protection
  • VPN (Tunnel)
  • Hosting malicious content or phishing
  • Spam or mass sending of unsolicited emails
  • Storage or distribution of content that infringes copyright

5. Contract Duration

5.1 Contract Duration

The duration of the contract is chosen by the user at the time of purchase and is specified in the service agreement.

5.2 Renewal

Services must be renewed before expiration to ensure continuous access. Failure to renew may result in service suspension.

6. Payments and Billing

6.1 Payment Methods

24racks cloud officially accepts payments through:

  • PayPal
  • Bank Transfer
  • Credit Card (through Stripe)

Payments are only valid if made through our official websites.

6.2 Data Access

Data related to machines/products are accessible only during the paid service period. If the service period expires or is revoked, access to the data will be terminated.

6.3 Automatic Renewals

Automatic renewals are performed when possible, subject to user authorization, to avoid service interruptions.

7. Responsibilities and Warranties

7.1 Service Provision

24racks cloud provides services "as is". The only external program preloaded on the operating system (only on VPS/VDS) is QEMU-Guest-User, necessary for remote control of the machine by the user and, if authorized, by the 24racks cloud team.

7.2 Acceptance of Terms

Users accept these terms of service when purchasing our services.

7.3 Service Damage

24racks cloud is not responsible for any action that damages the acquired service. However, we reserve the right to intervene directly to mitigate such damage.

8. Service Stability

8.1 Commitment

24racks cloud is committed to minimizing maintenance and downtime of its infrastructure to ensure high service availability.

8.2 Bandwidth Guarantee

24racks cloud guarantees a minimum input and output bandwidth of 500Mbit/s to ensure optimal performance.

9. Service Suspension

9.1 Violations

24racks cloud reserves the right to suspend or terminate service without prior notice if the user:

  • Violates the Terms of Service
  • Installs or uses malicious software such as viruses, trojans, botnets, spyware, etc.
  • Abuses the service
  • Provides false information (e.g., false address, name, and surname)
  • Damages 24racks cloud infrastructure

10. Traffic Usage

10.1 Limits

Data transfer limits for our services are clearly specified on the product page and at the time of purchase. Exceeding these limits may result in suspension or restriction of the connection.

10.2 Unrestricted Data Transfer

All dedicated servers come with unrestricted data transfer to support extensive usage needs.

10.3 Fair Use Policy

In cases of unfair use, 24racks cloud reserves the right to suspend or restrict traffic in scenarios of exceptionally high usage. This policy is intended to prevent network overload and deter attacks or excessive use of network resources. Users will receive an email notification at least 12 hours before any suspension.

11. Refund Policy

11.1 Service Issues

Refunds are only issued for verified server problems that:

  • Result in service availability less than 99.0% during the first month
  • Are directly caused by failures in our infrastructure
  • Cannot be resolved after multiple technical support attempts

11.2 Refund Period

Refund requests can be made within 7 days of purchase, subject to the following conditions:

11.2.1 First 24 Hours

Refunds requested within the first 24 hours will receive a full refund provided that:

  • The service has not been extensively used
  • No significant modifications have been made to the system
  • A valid reason for cancellation is provided

11.2.2 First 3 Days

Refunds requested within the first 3 days require valid reasons and will be evaluated by our team.

11.2.3 First Week

Refunds requested within the first week require valid reasons and will be evaluated by our team. The refund amount will be 50% of the total service price.

11.2.4 After the First Week

No refunds will be issued after the first week.

11.3 Start of Refund Period

The refund period begins from the moment of purchase, not from the moment of machine delivery.

11.4 Maximum Refunds

A maximum of 2 refunds can be requested every 7 days.

11.5 Dedicated Server Refunds

No refunds are issued on dedicated servers for any reason.

12. Contract Termination

12.1 Termination

24racks cloud reserves the right to terminate the contract at any time for valid reasons, without providing refunds.

13. Copyright

13.1 DMCA Protection

24racks cloud's copyrights are protected by DMCA. Unauthorized use of 24racks cloud's proprietary elements will result in legal action.

14. Licenses

14.1 Use of Licenses

By accepting the contract, the client certifies that all licenses provided by third parties are obtained from reliable sources and not from "nulled" licenses, illegal copies, or unauthorized vendors.

15. Abuse Requests

15.1 Reports

Abuse requests should be sent to asistencia@24racks.com.

15.2 Examination

Abuse requests will be examined within a maximum of 30 business days.

16. Changes to Terms of Service

16.1 Modifications

24racks cloud reserves the right to alter or modify the Terms of Service at any time to add or remove clauses, sections, and more. Users will be notified of significant changes.

16.2 Data Deletion

In case of service cancellation, users can request the deletion of their profile, which may take up to 90 days to complete.
