By accessing or using the services provided by 24RACKS CLOUD S.L., the user agrees to comply with these Terms of Service.

The user acknowledges that they have read, understood and accepted the conditions described herein.


2. Definitions

Client Area
The online portal where customers manage their services using their credentials.

Credentials
The email address and password used to access the client area.

Services
Any service provided by 24RACKS CLOUD S.L., including but not limited to web hosting, VPS, dedicated servers or related infrastructure services.


3. Service Delivery

Provisioning of services normally occurs within 7 days after payment confirmation.

For dedicated servers, provisioning may take up to 4 weeks depending on hardware preparation, configuration and installation requirements.


4. Customer Responsibilities

Customers agree to:

  • Provide accurate and truthful information when creating an account.

  • Maintain the confidentiality of their account credentials.

  • Use the services only for lawful purposes.

  • Ensure that software installed on their servers is properly licensed.

Accounts created with false information may be suspended or terminated.


5. Acceptable Use Policy

Customers may only use the infrastructure for lawful activities.

The following activities are strictly prohibited:

  • Cryptocurrency mining

  • Botnet operations

  • DDoS attacks

  • Malware distribution

  • Phishing activities

  • Spam or unsolicited email campaigns

  • Hosting illegal content

  • Copyright infringement

  • Network scanning intended to disrupt services

Use of VPNs or network tunnels is permitted provided that such use does not compromise the security, stability or integrity of the network infrastructure.


6. IP Address Usage

Each VPS or dedicated server may include assigned IP addresses.

IP addresses may not be used for illegal activity, including but not limited to:

  • DDoS attacks

  • botnet participation

  • spam distribution

  • fraudulent activity

Violation may result in immediate suspension.


7. Payments and Billing

Accepted payment methods include:

  • PayPal

  • Bank transfer

  • Credit or debit card via Stripe

Payments are considered valid only when processed through official billing channels.


8. Service Duration and Renewal

The service duration is determined at the time of purchase.

Customers are responsible for renewing services before expiration to avoid interruption.

Failure to renew may result in suspension or termination of services.


9. Data and Backups

24RACKS CLOUD S.L. respects the privacy of customers and does not access customer data without authorization, except when necessary to provide technical support.

Some services may include backup systems intended for infrastructure recovery purposes.

Backups do not replace the customer’s responsibility to maintain their own copies of their data.

Dedicated servers do not include automatic backups unless explicitly purchased.


10. Data Retention After Service Expiration

When a service expires or is terminated, data may remain temporarily stored.

Customer data may be permanently deleted after a minimum period of 7 days following service expiration.

Customers are responsible for retrieving their data before service termination.


11. Right of Withdrawal

In accordance with European consumer protection regulations, consumers normally have a right of withdrawal for distance contracts.

However, by purchasing the service and requesting immediate activation, the customer expressly consents to the immediate execution of the service.

As a result, the customer acknowledges that the right of withdrawal may be lost once the service has begun, in accordance with applicable legislation governing digital services.


12. Refund Policy

Refunds may be issued only in cases where verified technical issues occur due to infrastructure failure.

Refund requests must be submitted within 7 days of purchase.

Dedicated servers are generally non-refundable due to the hardware provisioning process, unless a failure attributable to the provider occurs.


13. Service Suspension

24RACKS CLOUD S.L. reserves the right to suspend or terminate services in the following cases:

  • violation of these Terms of Service

  • illegal activities

  • abuse of infrastructure

  • malware or malicious activity

  • fraudulent use of services

Whenever possible, the customer will be notified and given a reasonable opportunity to remedy the issue.

Immediate suspension may occur in cases involving security risks or illegal activities.


14. Service Availability

24RACKS CLOUD S.L. aims to maintain a stable and reliable infrastructure.

However, temporary interruptions may occur due to:

  • maintenance

  • hardware failure

  • network incidents

  • external attacks

The company will make reasonable efforts to restore service as quickly as possible.


15. Limitation of Liability

Services are provided “as is” and “as available.”

24RACKS CLOUD S.L. shall not be liable for:

  • indirect damages

  • loss of profits

  • business interruption

  • loss of data resulting from customer actions or third-party software

Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable law.


16. Intellectual Property

All content on the website including text, logos, designs and software is protected under applicable intellectual property laws.

Unauthorized reproduction or distribution is prohibited.


17. Abuse Reports

Reports of abuse, illegal activity or network misuse should be sent to:

abuse@24racks.com

Reports will normally be reviewed within 24 to 72 hours.


18. Changes to Terms

24RACKS CLOUD S.L. reserves the right to modify these Terms of Service at any time.

Updated terms will be published on this website.

Continued use of the services constitutes acceptance of the revised terms.


19. Governing Law

These Terms of Service are governed by the laws of Spain.

For disputes involving consumers, the competent courts shall be those corresponding to the consumer's place of residence.
